I'M JOHN STEWART AND I AM HAPPY TO BE HERE TODAY AND TO TURN THE MEETING OVER TO BEGIN TO THE HEAD OF PRESERVATION, HISTORIC PRESERVATION FOR THE CITY OF MIAMI BEACH, DEBBIE TACKETT.

UM, GOOD MORNING.

UH, FIRST AND FOREMOST, I WOULD LIKE TO WELCOME OUR NEWEST BOARD MEMBER, MITCH NOVIK.

UM, WELCOME BACK, I SHOULD SAY, TO THE HISTORIC PRESERVATION BOARD.

YOU'VE SERVED THIS COMMUNITY WELL OVER, UH, SEVERAL DECADES AND WE'RE DELIGHTED TO HAVE YOU HERE.

I DON'T KNOW IF YOU WANNA INTRODUCE YOURSELF OR SAY A FEW WORDS.

I'M MITCH NOVIK.

I'M A 37 YEAR RESIDENT.

IN 1989, I FORMED MY MIAMI BEACH BASED COMPANY, WHERE I RESTORED BUILDINGS FROM THE 1930S, FORTIES, AND FIFTIES, AND MANAGED THE, UH, OR CONTINUE TO MANAGE, UH, SOME OF THOSE PROPERTIES.

UH, AND PREVIOUSLY I SERVED ON THIS BOARD FOR SIX YEARS, FROM 2001 TO 2007, AT WHICH TIME I MOVED OVER TO THE COUNTY'S HISTORIC PRESERVATION BOARD AND SERVED UNTIL, UH, MID 2018.

UH, MOST NOTABLY, I'M ESPECIALLY PROUD OF HAVING SERVED ON FORMER MAYOR ER'S BLUE RIBBON PANEL ON THE STRUCTURAL INTEGRITY OF BUILDINGS WHERE WE ANALYZE THE CAUSE AND EFFECT FAILURE OF STRUCTURAL SYSTEMS. AND, UH, I'M PROUD A FEW OF OUR RECOMMENDATIONS HAD BEEN ADOPTED INTO CITY CODE, SUCH AS HOW DO YOU DEAL WITH CASES OF, UH, DEMOLITION BY NEGLECT OF CONFORMING AND NON-CONFORMING BUILDINGS, THE PRESUMPTION OF REPLICATION AND, UH, THE CRITICAL NEED, UH, FOR THIS CITY TO MAINTAIN A DATABASE OF VACANT BUILDINGS, UH, AS THOSE ARE THE MOST VULNERABLE TO DEMOLITION BY NEGLECT.

UM, I JUST WANNA ASK THAT BEFORE THE BOARD CONTINUES, THE 1800 MICHIGAN ITEM THAT YOU MIGHT CONSIDER PROVIDING GUIDANCE TO THE APPLICANT AND IMPLORING THEM TO SECURE THEIR PROPERTY AGAINST FURTHER DEGRADATION, UH, IN THEIR OWN APPLICATION, YOU'LL FIND A CERTIFIED REPORT FROM A PROFESSIONAL ENGINEER, WHICH FOUND MULTIPLE SOURCES OF ACTIVE MOISTURE INTRUSION.

AND THESE WERE CONSIDERED THE CAUSE OF THE MOISTURE DAMAGE IN THE HOME.

AND YET SINCE RECEIVING THIS REPORT OVER FOUR MONTHS AGO, THE APPLICANT HAS MADE NO EFFORT TO PATCH THE ACTIVE LEAKS.

AND I THINK IT, I FIND IT HARD TO GIVE THE BENEFIT OF THE DOUBT TO AN OWNER WHO KNOWS ABOUT MAJOR LEAKS IN THE ROOF, BUT DOESN'T FIX THEM.

AND THIS IS ALSO A VIOLATION EXHIBIT PROB, I JUST ASK THAT THE, UM, APPLICANT STOP THE ONGOING DEMOLITION BY NEGLECT BEFORE THEY RETURN TO CASES BOARD.

UM, DOES THE CITY DO ANYTHING ABOUT THAT? HOW DO WE HANDLE THE FACT THAT THERE IS A POTENTIAL, UH, NEGLECT ON THE PROPERTY AND THE SAFETY OF THE NEIGHBORING PROPERTIES? SO, UM, I'M AWARE THAT THERE ARE SEVERAL CODE COMPLIANCE VIOLATIONS FOR PROPERTY MAINTENANCE, UM, FOR THE SUBJECT SITE.

UM, I HAVE BEEN WORKING WITH THE APPLICANT.

WE HAVE A STAFF, UM, BEEN URGING THE APPLICANT TO PULL PERMITS FOR REPAIR.

UM, THERE'S NOTHING, EVEN THOUGH THEY HAVE A PENDING APPLICATION BEFORE THIS BOARD, THERE'S NOTHING THAT WOULD PREVENT THEM FROM PULLING BUILDING PERMITS FOR REPAIRING THE STRUCTURE.

UM, BUT TO MY KNOWLEDGE, ALTHOUGH THERE'S BEEN SOME ACTIVITY IN TERMS OF LOT CLEARANCE AND CLEANING OUT SOME OVERGROWN LANDSCAPING AND TRASH REMOVAL, UM, THERE HAS BEEN NO BUILDING PERMITS APPLIED FOR MR. CHAIR.

UH, DEBORAH, I'M ASSUMING THE PRO PROPERTY IS VACANT.

YOUR OPINION THAT TO ALLEVIATE ANY CONCERN A CONSTRUCTION FENCE, UH, PROPERLY SCREENED, UH, BE, UH, PLACED, UH, ALONG THE PUBLIC RIGHT OF WAY? YES, THAT IS ACTUALLY A REQUIREMENT, UM, FOR ANY VACANT PROPERTY THROUGHOUT THE CITY TO HAVE A, A, ACTUALLY A METAL PICKET FENCE TO SECURE THE PROPERTY AND TO SECURE ALL OF THE OPENINGS IN THE PROPERTY TO PREVENT ACCESS, UM, BY UNAUTHORIZED INDIVIDUALS.

SO I BELIEVE THAT IS ONE OF THE VIOLATIONS THAT HAS BEEN ISSUED FAILURE TO OBTAIN THE, THE BUILDING PERMIT FOR THE REQUIRED FENCING.

UM, AGAIN, WE ARE IN COMMUNICATION WITH THE APPLICANT AND WE DO, UM, URGE THEM TO CURE ALL VIOLATIONS, UM, AND POTENTIALLY EVEN MOVE FORWARD AND, AND TRY TO OBTAIN SOME BUILDING PERMITS FOR, FOR REPAIR OF THE BUILDING, WHICH ACCORDING TO THE DOCUMENTS WE'VE RECEIVED, WE THINK, UM, IS A GOOD IDEA.

SO ARE, ARE THERE, IS THERE ANYTHING THAT YOU CAN RECOMMEND THAT WE AS A BOARD, UH, DO AT THIS TIME? UH, ALONG, WELL, THIS, THIS, JUST TO ADDRESS WHAT THE PUBLIC COMMENT WAS, AND I'M NOT SURE THERE IS ANYTHING BUT THIS, THIS IS A REQUEST FOR A CONTINUANCE.

BUT AGAIN, THIS WOULD BE A RECOMMENDATION.

UM, THIS IS, EXCUSE ME, A RECOMMENDATION FROM STAFF.

IT'S CERTAINLY, UM, SOMETHING THE BOARD COULD, COULD RECOMMEND TO THE APPLICANT AT THIS TIME.

AT THIS TIME IN THE CONTINUANCE? YEAH.

WE ARE THE FAMILY THAT DIRECTLY ABUTS THE BACK OF THE PROPERTY, UH, TO WHICH THEY ARE, UH, PROPOSING THAT THEY BUILD A, UH, SECOND STORY ON TOP OF THEIR, UH, ONE STORY EXISTING GUEST HOUSE.

THE ONE STORY EXISTING GUEST HOUSE IS, YOU KNOW, SORT OF CLOSE AND WITHIN THE SETBACK OF MODERN TIMES.

AND THEY'RE, UH, LOOKING TO PUT A SECOND STORY ON THAT.

UH, WHEN WE HAD THE PREVIOUS MEETING, OBVIOUSLY THEY REQUIRED A VARIANCE TO BUILD OUT PAST THE 15 FEET, UH, WHICH IS WHAT'S REQUIRED WITH A SECOND STORY.

MY UNDERSTANDING OF THE CODE IS, IS NOT PERFECT.

UM, THE BOARD TOLD THEM TO COME BACK WITH A PROPOSAL THAT MET THE CODE, WHICH MEANT A, A SETBACK OF 15 FEET ON A MINIMUM.

ON THE SECOND STORY, IT APPEARS THAT WHAT THEY'VE ACTUALLY DONE IS PUT A HABITABLE ROOF DECK UP TO THE 15 FEET OR COVERED BALCONY, DEPENDING ON HOW YOU LOOK AT IT.

IN ADDITION, THEY DID THIS VERY WEIRD THING WHERE THEY COVERED UP THE SLIDING DOORS THAT LEAD TO THE OUTSIDE OF THE ROOF DECK WITH THE LABELS BATHROOM ONE AND BATHROOM TWO TO MAKE IT A LITTLE BIT MORE COMPLICATED TO SEE.

UH, DESPITE CLEAR DIRECTION FROM THE HPB IN ITS APRIL MEETING TO PRESERVE THE HISTORIC FAC FACADE, THE APPLICANT HAS AGAIN PROPOSED DEMOLITION AND ALTERATION TO THE DEFINING ELEMENTS OF THIS PROTECTED ART DECO STRUCTURE.

WE OPPOSE ELEVATING THE EYEBROWS ABOVE THEIR ORIGINAL LOCATION, SQUARING OFF THE ROUNDED ART DECO STYLING AND REPLACING CONCRETE ELEMENTS WITH ALUMINUM OR METAL MATERIALS.

THE PROPOSED LIGHTING CHANGES ARE INCOMPATIBLE WITH THE STYLE OF THE NEIGHBORHOOD.

THIS IS ONLY ONE OF THE FEW REMAINING SIGNIFICANT ART DECO HOMES IN SOUTH BEACH.

AND THESE ALTERATIONS FUNDAMENTALLY COMPRISE ITS COMPROMISE, ITS HISTORIC INTEGRITY.

AND THE BUILDING IS AFFECTED BY CONE'S, TRAFFIC, AND THEY ALREADY HAVE THIS OUTDOOR CAFE AND PEOPLE ARE CONSTANTLY, UH, LOOPING AROUND IN, IN FROM THE, UH, NEW PARK AREA.

THEY'RE BACKING UP, THEY'RE LOOPING AROUND AND THEY'RE GETTING THEIR CAPITO AND THEIR, UM, THEIR COFFEE IN THE MORNING.

UH, AND IT, IT OFTEN IS, UM, BLOCKING THE TRAFFIC, UM, AND SLOWING IT DOWN WELL WITH AN INCREASED AMOUNT OF SERVICES.

HAS THE CITY LOOKED AT THE IMPACT, UH, UH, OF THE, OF THE TRAFFIC AND, AND MADE ANY ACCOMMODATIONS? WE ALSO HAVING A MAJOR, UH, A PLANNED A, UM, UH, A MAJOR, YOU KNOW, $20 MILLION BUILDING IN THE PARKING LOT THAT'S CATTY CORNER FROM THIS IS OWN CAFE.

AND, AND THAT'S GOING TO ALSO INCREASE TRAFFIC.

SO THE CONGESTION, THE CITY HAS, THE CITY LOOKED AT, UM, ANY, UH, EFFECTS OF INCREASED CONGESTION OF THIS SERVICE.

AND THE
