IT HAS MANY LEGALLY NON-CONFORMING ELEMENTS INCLUDING

UM, SO THE APPLICANT IS REQUESTING A VARIANCE, UH, TO REDUCE BY ONE FOOT SIX INCHES.
THE REQUIRED INTERIOR SIDE SETBACK, WHICH IT'S REQUIRED TO BE FIVE FEET, UM, AND THIS WOULD REDUCE THAT SETBACK TO THREE FEET, SIX INCHES, UM, FOR THE INSTALLATION OF THE AIR CONDITIONING EQUIPMENT.
UM, THIS ISN'T AFTER THE FACT VARIANCE.
THE APPLICANT, UM, ATTEMPTED, ATTEMPTED TO GET A BUILDING PERMIT, RECEIVED ALL THE MECHANICAL ELECTRICAL REVIEWS.
HOWEVER, BECAUSE OF THE, UM, THE SETBACK ISSUES, UH, THE PLANNING DEPARTMENT WAS NOT ABLE TO SIGN OFF ON THAT BUILDING PERMIT.
UM, AND SO THEY'RE HERE TO REQUEST AN AFTER THE FACT VARIANCE FOR THAT PURPOSE.
UM, ADDITIONALLY WE EXPLORED ANY OTHER OPTIONS.
THE HOME HAS SLOPE, A SLOPED ROOF SYSTEM.
UM, THIS IS TYPICAL WITH THE MEDITERRANEAN STYLE ARCHITECTURE OF THE 1930S, UH, MEDITERRANEAN REVIVAL STYLE.
AND, UM, AND SO THERE'S NO ABILITY TO LOCATE THAT ON THE ROOF.
THERE'S NO, UH, IN THE REAR YARD THEY HAVE, UH, POOLS, TERRACES AND OTHER THINGS WHERE IT'S NOT PRACTICAL TO LOCATE, LOCATE IT THERE.
UM, SO THEY DO HAVE A PRACTICAL DIFFICULTY AND A HARDSHIP, UM, GIVEN THE EXISTING CONDITIONS OF THE HOME.
UM, SO WITH THAT, STAFF RECOMMENDS THAT THE VARIANCE BE APPROVED, UH, SUBJECT TO THE CONDITIONS IN THE ATTACHED DRAFT ORDER.
BEFORE WE PROCEED, DO I HAVE ANY DISCLOSURES FROM THE BOARD THIS MORNING ON THIS ITEM? OKAY.

IT WAS VERY COMPLICATED, OBVIOUSLY, TO, TO GET THINGS DONE.
AND APPARENTLY THE, THE CONTRACTOR DID NOT CLOSE THE PERMIT PROPERLY.
SO WHEN I TRIED TO REOPEN THAT PERMIT AND DO THE THINGS PROPERLY, I WAS TOLD THAT THE UNIT COULD STAY, UH, IN THIS LOCATION DUE TO THE SETBACK.
WHEN I BOUGHT THE HOUSE, THE UNIT WERE THERE.
FROM MY UNDERSTANDING, THEY'VE BEEN THERE FOR OVER 30 YEARS BASED ON THE NEIGHBORS WHAT THEY TOLD ME.
SO, YOU KNOW, THAT, THAT'S WHY I'M HERE.

WHEN YOU TRIED TO CLOSE THE PERMIT? YEAH, I MEAN MY, MY UNDERSTANDING WAS ALL I WANTED TO DO IS BASICALLY TAKE THE OLD UNIT AND PUT THE NEW ONES.
SO WHEN WE TRY TO DO THAT, WE APPLIED FOR A PERMIT TO REDO THE, THE AC UH, UH, SYSTEM TO MAKE IT NEW.
AND WE GET STUCK BY THE SITUATION BECAUSE GOING TO THE PLANNING, EVERYTHING WAS APPROVED BESIDE THE PLANNING, WHICH SAYS THAT THE UNIT DOESN'T HAVE THE PROPER SETBACK.
SO THEY REQUESTED FROM ME A SURVEY BACK FROM 19, UH, 2019 BEFORE I PURCHASED THEIR EYES TO SHOW THAT UNIT WHERE THEY HAD THE SURVEY, BUT THE SURVEY DIDN'T SHOW ANY UNITS.
THEY DIDN'T PUT THE, THE AC UNIT ON THE SURVEY.
SO I NO OTHER WAY TO TELL THEM THAT IT WAS THERE BESIDE, I ASKED THEM, YOU KNOW, UH, WHAT ELSE CAN I DO? THE, THE ARCHITECTS WHO DID THE PLAN WHEN I BOUGHT THE HOUSE, PUT THE UNIT THERE AS EXISTING, BUT THEY DON'T WANT TO HEAR ANYTHING.
AND THEY TOLD ME IT'S EITHER I HAVE A SURVEY THAT IS, UH, PRIOR SHOWING THE UNIT AT THIS LOCATION OR I HAVE TO APPLY FOR VARIANCE AND THAT'S WHY I'M HERE.
UH, OTHER, OTHER QUESTIONS FROM THE BOARD? UM, I'VE GOT A QUESTION.
'CAUSE YOU KNOW, I DO GO AND I, I GO TO ALL THE SITE VISITS AND OBVIOUSLY I COULDN'T LOOK AT THE AIR CONDITIONERS BECAUSE OBVIOUSLY I WOULD BE INFRINGING ON YOUR PROPERTY.
SO, UM, SO YOU WON'T ME, THIS IS THE ORIGINAL LOCATION OF WHERE IT WAS WHEN YOU BOUGHT THE HOUSE, CORRECT? YES, YES.
SO THE UNITS AND, AND IT'S, IT'S VERY NA IT'S VERY NARROW, OBVIOUSLY, RIGHT? IT'S, IT'S QUITE NARROW.
YOU STILL HAVE SOME ENOUGH ROOM TO PASS BY AND DO REPAIRS AND THERE IS A FENCE ALSO THAT SEPARATE, UH, FROM THE, THE HOUSE NEXT DOOR.
UH, LIKE I SAID, THEY'VE BEEN HERE FOR A VERY LONG TIME AND FROM MY UNDERSTANDING THERE WERE NO COMPLAINT, THERE WERE NO ISSUES.
SO WHAT, HOW, WHEN WERE THESE INSTALLED AGAIN? I'M SORRY? WHEN WERE THESE AC UNITS INSTALLED? WHAT, WHAT YEAR? THE, THE MINE WERE INSTALLED IN 2020, BUT WE EXCHANGED IT WITH THE PREVIOUS ONE WHO WERE THERE PRIOR TO THAT.
AND THEN YOU WERE TRYING TO, YOU WERE DOING SOME ADDITIONAL WORK

AND PULLED THE PERMIT AND THEY SAW, THAT'S WHEN IT WAS FOUND THAT THIS, UH, NO, WHAT HAPPENED IS THAT THEY DIDN'T CLOSE THE PERMIT.WHEN I BOUGHT THE HOUSE IN 2019, I DID THE BENCH OF WORK, WINDOWS, ROOF, ACS.
SO THEY APPLIED FOR ALL THESE PERMITS DURING THE, THE PERMITTING PROCESS.
UH, THEY WERE NOT ABLE, THAT'S MY UNDERSTANDING THAT I HAVE NOT, YOU DON'T KNOW AT THE TIME IS THAT THE CONTRACTOR COULDN'T CLOSE THIS PERMIT BECAUSE HE HAD AN ISSUE WITH THE, WITH THE AC UNIT BEING ON THE SIDE AND HE TRIED TO FIND A WAY TO PUT THEM SOMEWHERE ELSE, BUT THERE'S NO OTHER WAY.
SO HE THOUGHT THE ARCHITECT THOUGHT THAT WE'RE GONNA MOVE THEM FOR NOW, AND THEN WE ARE GONNA EXPLAIN THE SITUATION BECAUSE IT WAS VERY DIFFICULT AT THE TIME FROM UNDERSTANDING TO GET ANYTHING DONE.
SO BASICALLY THEY, THEY JUST DID THE WORK, THEY CLOSE THE PERMIT AND I HAD NO IDEA ABOUT IT.
FIVE YEARS LATER, I RECEIVED A, A VIOLATION FOR IT BECAUSE THE PERMIT WAS EXPIRED AND THIS IS HOW I STARTED THIS ENTIRE PROCESS.
AND, UM, SO BASICALLY THEY PUT THE UNIT THERE, THEY DID NOT CLOSE THE PERMIT AND I GOT A VIOLATION FIVE YEARS LATER.
SO IF WE APPROVE THIS VARIANCE AFTER THE FACT VARIANCE, IT WILL STAY WITH THE HOUSE LIKE, UM, YOU KNOW, ACS LAST, IF YOU'RE LUCKY, 10 YEARS.
SO THEY DON'T BECOME EFFICIENT AFTER 10 YEARS.
SO SAY ANOTHER OWNER COMES IN WHERE HE HAS TO REPLACE, THE OWNER HAS TO REPLACE THESE ACS, HE'LL STILL BE ABLE TO REPLACE HIM IN THE SAME LOCATION, SO IT'LL STAY WITH THE HOUSE WITH THE OWNER? THAT'S CORRECT.
IT WOULD STAY, IT WOULD STAY WITH THE HOUSE.
IT'D BE, WE WOULD RECORD THE ORDER ON THE PROPERTY.
SO IN THE FUTURE, IF THEY EVER NEEDED TO GET A BUILDING PERMIT FOR AN AIR CONDITIONER, IT WOULD SHOW THAT THIS VARIANCE EXISTS WAS APPROVED AND, AND THEY WOULD BE ABLE TO MAKE THAT REPAIR.

SO THEN HOW COME IT WAS NEVER APPROVED? I MEAN, IF THIS HAS BEEN THERE LIKE THAT, I MEAN, WAS IT JUST AS BUILT INITIALLY AND IT WASN'T, IT WASN'T THE, THAT SETBACK DIDN'T EXIST AT THE TIME THE HOUSE WAS ORIGINALLY BUILT.
IS THAT WHY THERE'S NO, YOU KNOW, ATTACHED VARIANCE THAT ALREADY EXISTS? IT'S, IT'S LIKELY WHEN THE AIR CONDITIONER WAS PUT IN 30, 30 YEARS AGO THAT THEY PROBABLY DID IT WITHOUT A PERMIT.
THE HOUSE IS FROM THE 1930S, SO IT PROBABLY HAD BOX BOX AIR CONDITIONING UNITS AT SOME POINT THAT GOT REPLACED.
UM, AND WE DON'T HAVE ANY RECORDS OF THERE BEING ANY, ANY PERMITS FOR, UM, FOR CHANGING AND, AND INSTALLING A, UM, A CENTRAL AIR CONDITIONING SYSTEM ON THE HOME.
SO IT'S POSSIBLE THAT THEY DID IT AND WE JUST LOST THE RECORDS THERE.

THAT ACCESSORY BUILDING, UH, UH, ACCESSORY BUILDING IS A DETACHED BUILDING, NOT PART OF THE MAIN HOME, UH, CONTAINS A CARPORT AND A WHAT APPEARS TO BE A GUEST HOUSE, UM, IN, IN THAT FRONT UNIT.
THE APPLICANT IN THIS CASE IS PROPOSING TO DEMOLISH THAT STRUCTURE AND BUILD A NEW, UH, THREE CAR GARAGE, UH, STRUCTURE THAT ALSO HAS AN ACCESSORY DWELLING UNITS.
AS PART OF THIS, UM, PROCESS, WE'VE WORKED WITH THE APPLICANT SO THAT THEY CAN REDUCE THE EXISTING NON-CONFORMANCES.
SO THEY WILL STILL HAVE ELEMENTS THAT ARE NON-CONFORMING TO THE CODE, BUT THOSE NON-CONFORMING ELEMENTS WILL BE SIGNIFICANTLY REDUCED AS PART OF THIS APPLICATION.
UM, SO LET ME READ WHAT THE THREE VARIANCE, WHAT THE TWO VARIANCES ARE.
UM, THE FIR THE FIRST VARIANCE IS TO REDUCE THE REQUIREMENT FOR AN INTERIOR SIDE SETBACK OF SEVEN FEET, SIX INCHES TO ALLOW FOR AN EXISTING INTERIOR SIDE SETBACK OF 2.68 FEET, UH, TO BE FOLLOWED AND MAINTAINED FOR THE CONSTRUCTION OF THE NEW GARAGE.
AND THEN THE SECOND IS A VARIANCE, UM, FOR THE MAXIMUM UNIT SIZE OF 50% TO ALLOW FOR A MAXIMUM UNIT SIZE OF 58.4% WITH THE TWO VARIANCES.
UM, THE SIDE SETBACK OF TWO OF 2.68 FEET.
